ACCEPTABLE USE POLICY

This Acceptable Use Policy (“AUP”) describes acceptable and prohibited uses of the TrackIt services, websites, applications, and related platforms (collectively, the “Services”). This AUP applies to all users of the Services, including customers, vendors, sellers, buyers, and authorised users (“Users”).
This AUP is incorporated by reference into and forms part of the applicable agreement(s) governing your use of the Services, including the Terms of Service, Customer Agreement, Vendor Agreement, and any applicable Order.
1. PURPOSE AND PRINCIPLES
TrackIt provides the Services to enable lawful, secure, and fair use by motorsport teams, OEMs, vendors, and related participants. This AUP is designed to: - protect the security, availability, and integrity of the Services; - protect TrackIt, Users, and third parties from harm; - ensure compliance with applicable laws and regulations; and - provide clear grounds for enforcement where misuse occurs.
2. PERMITTED USE
Users may access and use the Services solely: - for lawful purposes; - in accordance with the applicable agreement(s); - in a manner consistent with the intended functionality of the Services; and - in compliance with all applicable laws, regulations, and industry standards.
3. PROHIBITED USES
Users must not, and must not permit any third party to, directly or indirectly engage in any of the following activities:
3.1 Unlawful or Harmful Activities

Use the Services in violation of any applicable law or regulation;

Use the Services to promote, facilitate, or engage in fraudulent, deceptive, or misleading activities;

Use the Services in a manner that poses a risk of physical harm, death, or property damage, except as expressly contemplated by the Services and applicable agreements.
3.2 Security and Platform Integrity

Attempt to gain unauthorised access to the Services, accounts, systems, networks, or data;

Circumvent, disable, or interfere with security-related features, access controls, or technical safeguards;

Probe, scan, or test the vulnerability of the Services, except where expressly permitted in writing by TrackIt;

Introduce malware, viruses, worms, or other harmful code;
-
Interfere with or disrupt the availability, performance, or integrity of the Services or related systems.
3.3 Data Misuse and Privacy

Process, upload, or transmit personal data without having a lawful basis to do so;

Upload or process special category data or other data types prohibited under the applicable agreement(s);

Use the Services to collect, store, or process personal data in a manner that violates data protection or privacy laws;

Attempt to re-identify anonymised or aggregated data.
3.4 Intellectual Property and Confidentiality

Infringe, misappropriate, or violate the intellectual property or proprietary rights of TrackIt or any third party;

Reverse engineer, decompile, disassemble, or attempt to derive source code, algorithms, or models from the Services, except to the extent permitted by applicable law;

Remove, obscure, or alter proprietary notices;
-
Use the Services to disclose or misuse confidential information without authorisation.
3.5 Marketplace and Commercial Misuse

Misrepresent products, services, or pricing offered through the Services;

Sell or promote unlawful, unsafe, or non-compliant products;
-
Circumvent marketplace fees, payment mechanisms, or contractual obligations;

Engage in abusive, deceptive, or unfair practices toward other Users.
3.6 Automated Use and Scraping

Use bots, scrapers, crawlers, or automated tools to access the Services, except where expressly permitted by TrackIt;

Use automated systems in a manner that degrades, disrupts, or interferes with the Services;

Use accessibility, testing, or security tools in a way that materially degrades or disrupts the Services.
3.7 Misuse of AI or Analytics Features

Use AI-enabled features in a manner that violates applicable law or third-party rights;
-
Rely on AI-generated outputs as a substitute for professional judgment in safety-critical or regulated contexts;

Use outputs to make decisions that result in unlawful discrimination or harm.
4. USER RESPONSIBILITIES
Users are responsible for: - maintaining the confidentiality of account credentials; - ensuring that all activity under their account complies with this AUP; - promptly notifying TrackIt of any suspected security incident, misuse, or unauthorised access; - ensuring that their Users, employees, and contractors comply with this AUP.
5. ENFORCEMENT
TrackIt may investigate suspected violations of this AUP and take appropriate action, including: - suspending or restricting access to the Services; - removing or disabling access to content; - terminating accounts or agreements; - reporting unlawful activity to relevant authorities.
Except where prohibited by law or where immediate action is required to prevent harm, TrackIt will use commercially reasonable efforts to provide notice of enforcement actions.

7. CHANGES TO THIS AUP
We may update this AUP from time to time to reflect changes in law, technology, or our Services. Material changes will be communicated through the Services or by other reasonable means.
